XII ICAO/ASPA Regional Seminar
Use and Legal Protection of Safety Information and its related Sources
ICAO will hold, in cooperation with the Asociacion Sindical de Pilotos Aviadores (ASPA) de Mexico the XII ICAO/ASPA Regional Seminar, the Seminar will take place at ASPA’s Auditorium in Mexico City, Mexico from 14 to 15 May, 2014. The main subject for this year is the Use and Legal Protection of Safety Information and its related Sources. The working languages of the seminar will be Spanish and English, with simultaneous interpretation provided. Participation is free of charge. It is envisioned that the audience will combine a mix of representatives from civil aviation authorities, judicial authorities, airlines and international speakers.
Objective
This seminar is to inform and raise awareness about the importance of having a safety reporting system that collects voluntarily submitted reports about incident/situation in aviation to identify risks and implement necessary mitigating measures. The success of these reporting mechanisms depends, in part, on the existence of effective legal safeguards that afford appropriate protection to the data and related sources without impeding necessary and appropriate use, thereby encouraging meaningful reporting and analysis processes that proactively address safety issues. The utility of these systems is to improve aviation safety in each State of the Region according to statement in Annex 19 – Safety Management and the Global Aviation Safety Plan (GASP).
In the past few years, the countries that have a reporting system have collected more reports at the beginning of the implementation; the numbers on these reports assume a consolidation of the reporting system as a basic tool that provides accurate information for aviation safety. This achievement would not have been possible without the collaboration of aviation professionals and industry.
To encourage the use of reports from professionals such as pilots, air traffic controllers, maintenance technicians and other employees of the aviation sector, it is essential two conditions: the protection of the informant and the confidentiality of the information. The employee should not suffer punitive actions from the employer or authorities unless the competent authority determines, in accordance with applicable laws, that the occurrence may have been caused by an act with the intent to cause damage or a conduct constituting gross negligence or wilful misconduct.
The main purpose of establishing an adequate legal framework for the appropriate use and protection of safety information and its related sources it to create an environment of trust that allows the proper flow of information between aviation safety management systems and these two concepts: the protection of the informant and confidentiality of the information in order to create a climate of trust that facilitates to professionals (especially pilots), the work report that finally will be provided to the authorities.
Venue
ASPA’s Auditorium has a maximum capacity for 200 participants. Since registration for the Seminar will be on a “first-come, first-served” basis, I would therefore like to encourage you to register at your earliest convenience.

Accommodation
Participants are responsible for their own hotel reservations (please refer to Attachment C and Hotel Reservation Form). ASPA will provide daily transportation between the Galeria Plaza Hotel and the seminar venue. Additionally, two alternative hotels recommended by ICAO are included in the Attachment C. These hotels are close to the Galeria Plaza Hotel.
